How ridiculous is this

I can see this case is no case at all and if all the facts are a clear as stated then it is a shame. Unfounded lawsuits run up the cost of insurance and everything we buy.
On the other hand, capitalism and some capitalists fail to sell safe or reputable products or services. The fact is that litigation and regulation must be part of the equation or the rule of law will fail.

Fishing for prawns is much more simple.
 
i have know knowledge of a state or federal cap on individual negligence liability for either property damage of bodily in jury. if that was the case we would not be selling umbrella policies, and today the norm is no longer $1,000,000. but rather two or up to 5 million. incidentally, the difference in price from 1m to 5m is only about $400. annually, hardly worth arguing about.
another item that supports no limits regarding civil negligence acts is the increase is popularity of irrevocable trust, sold to shelter one's estate from litigation.
but then, what the hell do i know!

I agree that this suit is bogus, but can't agree with the lawyer comments. We all hate them until we are wronged or harmed and then the lawyer is in OUR corner and things look very different. Now he's the good guy, the one fighting for you against the enemy. Because after all, my suit is different, all the others are ambulance chasing, but mine is the real deal.
You hear about this all the time on the forums, especially in product liability and defect disputes, just look at The Hull Truth: they all hate lawyers until there is a problem with a new boat or with dealer repairs and they are jumping up and down to sue! sue! sue! I'm just saying that it takes two to tango and if you want to sue someone an attorney will be glad to take your money and let a judge sort it out.
 
Didn't mean to start a lawyer bashing thread, just wanted to share what I saw in the trades . There are good and bad versions of everything. Taking responsibility for ones actions or mistakes is what really is wrong with this picture . So many challenges and circumstances are conspiring to end the boat business as we know it , and this certainly does not help matters.

Yes there is a place for law suits & Lawyers when real negligence occurs. People can suffer serious injury. The problem is Lawyers take 30 or 40% for themselves.A quadriplegic needs this money for a life time and the huge fees Attorneys charge in my opinion are immoral. These high fees are also a hidden tax on us all & especially make it hard for small businesses to survive.
Sorry for getting on the soap box.I'm putting it out of my mind & getting back to planning our Lake Superior cruise this summer! Alan on Simplicity
