If you don't want to share your pictures, don't make them public on the internet. If they are copyrighted, and marked as such, you can try to make a claim. Otherwise, Why whine?

Sarge, best of luck with the hemoroids, and James TSXD, you said I stole about 50 times (possible patent attorney?) so I've got your input. I will try to figure out the permissions thing and will work to violate less and expect to have it done this weekend. And by-the-way, ANYBODY could have called or e-mailed or PM'ed me and had this done sooner. We're open 7 days a week. But is more fun this way I guess.

To the moderators, please let me know if I'm punished, sanctioned or whatever. I have always been treated fairly by you.

Well, John, you certainly have a flair for exaggeration: 50 times??? Really??? Perhaps it's meant as sarcasm? I am not a patent attorney, though I have experience in the patent/trademark/copyright area. If you've read any of my posts (other than this inane thread), you'd know we are about the good times with these boats. Frankly, the only thing I'd like to see out of this whole mess is to follow the ONE RULE here: be nice.

So that we don't skip back and forth between the two threads, there is no need to respond to this post. I wish you folks no ill will. Hopefully we all learned something from this. Images (and, yes, even images on the net) are protected by federal copyright laws. Of course, that doesn't mean that scoundrels won't be out there, Dave, my buddy. :wink: And I certainly learned how happy I am to be retired.

So far 100% approval. I'm resubmitting requests in a new format. Zero complaints. Most of the BRATS know us and approve. No pictures need to be changed, but if you change your mind or I missed something please PM or E-Mail me and I'll get it changed same day.
And the members sending me the jokes about this, much appreciated. Was in a pretty lousey mood after being crucified on line for days, as you may have picked up. FLAGOLD's coffe mug is still the funniest, but the others are clever and spirit lifting.

Now let's just let this thing die the undignified passing it deserves...
 
Sheesh...why does this crap always happen when I'm on vacation?

I've no time (or desire) to delve deeply into this mess, but here's my quick take:

- JamesTXD is absolutely right. There is no permission implied or granted for photos posted here beyond our use at the C-Brats. This is basic copyright law, as this non-lawyer understands things.

- That being said, I think in this circumstance, New Hampshire Guy should not be tarred and feathered. They are great folks, and this was certainly not a situation where they were knowingly taking advantage of people - cut them some slack. They did ask at one time about using photos, and perhaps I shouldn't have been so generous in my reply - if that's a problem, whatever...sue me. I thought my reply was reasonable. They also were also quick to reply here with a satisfactory resolution.

- Those that are requesting albums be locked down, forget it. I've no desire to become a middleman in any such mess between users here and their "intellectual property". If you don't want the entire Internet to see your photos (through this site), don't post them. If you have concerns about them being used elsewhere, that's between you and the person using them.

- Those that have figured out how to lock down their own albums - sorry, that ain't gonna fly either. I was under the assumption nobody but the admins could do that, and when time permits, I'll be revoking that privilege and making all albums public. Why? Well...we don't supply bandwidth and disk storage for people's private use. We supply them for the benefit of the ENTIRE C-Brat community.

And now...back to my regularly scheduled vacation. Do me a favor, y'all...try not to blow this thing outta proportion, so I can enjoy a few days off away from the 'puter, mmmkay?

As some of you may have noticed, I have deleted my previous post in this thread. That post was made in haste and when I type/say things in a hurry, they don't always come out the way they should. So, here is a more thoughtfully considered response, using most the same words but much lighter on the sarcasm.

First, I am deeply sorry for both my previous post in this thread and my use of the photos in the identified advertising without specific permission from the owners. I apologize to any I have offended with either action. As of right now, I do not know of anyone who I had not been in some contact with, but this will go easier if we assume I posted a picture without permission.
As I noted in my earlier, clumsy post, when we were new to this site and C-Dory sale, we asked if there were any members who would allow us to use their pictures at a boat show. We were new dealers and the factory pictures were pretty bland. The outpouring of support was enormous. We were sent CD Roms, etc. While the original request was for a boat show, many people sent photos with fairly generic statements that at least implied they were happy for us to use their photos to promote C-Dory. Somewhat similar statements were made on this site in that earlier thread. We did use some of those photos in the boat show and at the time, we did acknowledge the C-Brat site.

That was about 2 years ago and my memory faded a bit. Given that initial response and my recollection of how supportive people were with regards to promoting "C-Doryism", I made the mistake of believing that it was OK to use photos from this site in more general advertising of the boat. I recognize now that I was very wrong in making that assumption. As I noted previously, I did this on my own as an employee and the Owners of Y-Landing Marina don't know or understand that I was potentially violating copyright with my use of these photos. To tell you the truth, until this thread, I didn't know either. So for that I am very sorry.

I can assure you that neither I nor Y-Landing marina will make the same mistake again and if we use photos from members of this site, those photos will be used with the explicit permission of the member who took the photo and under terms agreed upon with the member. I still believe at this time that we had permission, however unspecific, for the photos we've used. It is obvious that is not enough and the corrected requests are being sent out starting today. I really didn't know. So far we have not rec'd any complaints, but this was quite the wake-up call. I still wish it had been handled in a different way, but these posts are open for a reason, and the msg was rec'd loud and clear!

To the excellent photographers and Brats who have supported us in the past, and who I hope will continue to support us in the future THANK YOU.

To all the Brats, I again apologize and promise we will do better in the future.

For what it's worth, John wrote a nice PM to me asking for permission to use my photos. Here was my reply -

"Unfortunately, I don't have too many photos in my album that are advertising worthy. None-the-less, I hereby grant you and the fine people at Y-Landing to use any photo of a C-dory that I have posted on the C-brat site in advertising. I make this grant free of charge and in perpetuity. The only thing I ask is that you don't use photos with identifiable people in them as that would require a release from the person. "

As I recall, this site was started by a couple guys in response to a similar C-Dory site run by a self proclaimed "Benevolent Dictator". Several of our current members were kicked off that other site for actions deemed far worse than anything you have done. I got busted for inviting members of both groups to stay at my place at the same time, apparently this was a major social blunder.

I've always enjoyed this site due to the willingness of everyone to share their ideas. Without this bunch, few would know what a "Barber" chair is and I highly doubt the C-Dory factory would be as refined and customer driven. I can understand those who may not appreciate their photo's being used, I also remember how excited and proud we all were when the Factory used a Red Fox photo on it's brochure.

Guess you fit right in with the rest of us pirates!

Some of the previous posts raised my iconoclaste hackles pretty high. Anal retentives seem to do that - maybe it's a carry over from dealing with folk who seem to spend way too much time devising ways to point fingers and cover their anal sphinter rather than just sitting back, using good sense, and being realistic.

AFAIC, leave game playing to the professionals. This here is a bunch 'a "Brats" and it's damn hard to pigeonhole Brats. Easier to herd cats....
