warranty please help...........

I have read the warranty on the c-dory. Does the warranty transfer to second owner. Some states are different. I called local dealer today and he is going to check with factory monday. I pulled my tanks today for inspection. Found that floor is rotten due to leakage around screws.

From what I've read, I think the warranty does not transfer.
 
The question of warantee transfer becomes even more important with new owners of the company. They could hold the line that no warantee is transferable--that the old companies warantee is not transferiable, or step up to the plate and fix a problem, which in my opinion is due to known faulty workmanship at the factory.

In the past the company under the Reynolds did repair defects which were within the 5 year peroid...but there were exceptions. It appeared that anything which made the boat unusuable, was often covered (including safety items, such as leaking fuel tanks).

On the other hand, the area of rot may be small; the floor area core routed out and then the area filled with thickened epoxy and the screws are properly put into the solid epoxy, along with an appropiate sealer.
 
C-Dory warranty terms were not written as clearly as they could have been.

Nowhere in the warranty terms listed in the owners manual, does it limit coverage to the original owner, nor exclude coverage to subsequent buyers. However, it does state, that the original buyer must return the boat for repair.

Further adding to the confusion, the most recent brochure from C-Dory, states the hull warranty is transferable.

However, Bob raised a valid point - I've heard nothing regarding the new owner's intentions or obligations in this regard. Were C-Dory simply sold to new owners, one might think warranty coverage would follow. However, my limited understanding is only the assets of C-Dory were purchased - and none of the obligations. The boats will continue to be built, but by a different company.

Now...setting all of the above aside, is the rot the typical minor stuff we've seen reported here? If so, it's probably less hassle to fix it yourself - even if it's covered under warranty, and the new owners offer to repair it. It's a pretty simple job, if the damage is limited to the immediate area around the screw holes.
 
Yup -

The overwhelming majority of company sales are asset sales not stock sales.
This leaves all the known, and unknown, liabilities with the old company.
Many times new ownership will honor some things like gift certificates but
more often it seems you have to look for relief to the old owner :cry
 
Before cutting anything I wanted to get factory opinion. Just in case when I get in there and the damage has traveled further than expected. I am going to get a moisture meter today and check the whole floor. The warranty online has a date of 2000 and the site update is dated 2007. Who knows. As for the new owner I feel he took on warranty issues when he purchased the company. I would assume he read the brats site to get a good idea of what he purchased. He should be aware of quality control issues in the past. One does not have to be a boat builder to know caulk does not stick to starboard. I may be out of luck on the transfer. However, The original owners should be covered. I think it would get kind of expensive flying all around the country to small claims court. New or old owner someone is liable for warranty work. The brochure states the warranty transfers. Does anyone have any older brochures around.
